In the last five decades good number of important and landmark judgments of the Supreme Court and the High Courts were passed in exercise of Writ Jurisdiction. There has been great advancement of law in this field and pronouncements of Writ Courts have touched day-to-day life of the citizens. Writ Courts govern themselves on the basis of evolution of law based on precedents, as there is no codified law on the subject. This makes the task complex and difficult. This book has made a sincere effort to explain the basic princiles on which writ jurisdiction is exerciesed, dealing with every aspect of it with reference to relevant case laws. Separate chapters have been dedicated on various aspects, such as, who can apply, against whom writ lies, effect of alternative remedy, suppression, delay and laches etc. It has also been anahlsed as to whenwrit jurisdicction can be invoked in contractual matters, election disputes, legislative privileges and anit-defection etc. When the Writ Court would grant interim relief, consequential relief and pass declaratory order, has been explained. A separate chapter on different facets of natural justice is a highlight of the book. So also, scope of interference with administrative decisions of executive, has been elucidated. Meaning of writs of habeas corpus, mandamus, prohibition, quowarranto and certiorari has been explained in a user-friendly manner. General principles of Public Interest Litigation and purposes for which it can be filed, have been summarized in separate chapter. The appendix contains important pre-constitutional documents on writ jurisdiction and Constituent Assembly Debates. Relevant High Court and Supreme Court Rules regarding exercise of writ jurisdiction have also been appended. It would be extremely useful for all the practicing advocates, Judges and academicians.
