Law Relating to Building Contracts

Construction industry is increasing in importance and magnitude with the development of the country and has recevied a quantum jump with the country qualifying as a developed country. The manner and method of construction has been modernised and has become professionals team work job, with their rights and obligations well defined by law and delineated by contract. If one of them defaults or delays, the whole machinery is thrown out of gear and huge losses result, responsibility for which has to be determined according to law and contract between the parties. Normally arbitration is resorted to for the purpose. In order to serve as a guide to the parties and the arbitrator regarding their rights and obligations, their powers and duties, a book on the subject, compact, clear and comprehensive is called for. This book seeks to meet this need. The chapter on arbitration has been updated as per the New Arbitration and Conciliation Act, 1996. Wherever possible, supporting legal authorities have been given and case law cited.
It is hoped that the book would be for use to the parites concerned with construction activities and to their legal advisiors as pointers for further and detailed research on the legal issues involved.
