GUIDE TO CENTRAL EXCISE LAW & PRACTICE

The Central Excises and Salt Act, 1944 is now the most important fiscal enactment, yielding the largest amount of revenue to the Central Government. It has also the dubious distinction of being the most complicated and cumbersome branch of law in the country. The law of Central Excise has to be understood by considering Central Excise Act (about 60 Sections), Excise Rules (about 300 Rules), Central Excise Tariff (21 Sections, 96 Chapters and over 5000 entries). Valuation Rules, CEGAT (Procedure) Rules, plus over twenty allied Acts and Rules relating to additional duties of excise and cess. To add to this confusion, no branch of law is amended as frequently as excise-law. The Central Excise Rules were amended 14 times in 1985, 17 times in 1986 and 13 times in 1987. Over 400 notifications are issued each year, making an average of about 1.9 notification for each working day, and introducing more confusion in a subject where enough already exists.

A unique feature of the book is that Tribunal Orders have been separately dealt with and commented upon. The Tribunal (CEGAT) is a quasi-judicial\\\\\\\" body and subordinate to the Supreme Court and High Courts. In any authoritative commentary, it would be incorrect and inappropriate to club decisions of the Courts and the Tribunal together. At the same time, the decisions of the Tribunal are important and must be considered. Therefore, under every section/rule, the book deals with Case-laws from the Supreme Court/ High Court first and then it is followed with the title \\\\\\\"CEGAT Rulings\\\\\\\" wherein Tribunal decisions have been dealt with. The net result is that Case-laws are presented in a crystal-clear manner and the reader knows exactly the decision of the Courts or Tribunals on any subject. Guide to Central Excise is an attempt at fulfilling this need. The book contains an exhaustive commentary on all branches of excise law with extensive Indices, Charts, Comparative Tables and Practice Notes.
